Maharashtra govt to provide Rs. 5 lakh assistance to children who have lost their parents during Corona period

Maharashtra Women and Child Development Minister Yashomati Thakur has said that the state government will provide all kinds of assistance to the children who have lost their parents during the Corona period and will provide Rs. 5 lakh assistance to such children.

She further said that a task force is set up under the chairmanship of District Collector Rajesh Narvekar to rehabilitate every orphan. A survey of orphans is underway and care has been taken to ensure that no child is deprived. Efforts are also being made to increase the childcare fund for child development, Thakur said.

Thakur has said that it is necessary to keep in touch with the child victims and provide emotional support therefore. At present, the number of orphans due is 42 in Thane district.

He said, strict preventive measures are required to contain transmission of this variant. On the Delta Plus variant, Dr. Paul has said it has not been classified as a variant of concern. He said, this variant nullifies the use of monoclonal antibodies as per the data available in public domain. He said, more scientific study is required to learn about this variant.

Talking about the COVID vaccine Novavax, Dr. Paul has said, this vaccine is very safe and highly effective. He said, the data available in the public domain proves it. He said, efficacy of this vaccine is over 90 per cent and this will be produced in India.

On the vaccination front, Dr. Paul has said that the Central Government with the active support of States and Union Territories are working together for scaling up the vaccination coverage.

Prasar Bharati CEO, Shashi Shekhar Vempati addressed the third ABU-RAI DAYS 2021 discussion on โ€œA new world out of COVID: Can Public Service Media help to create more open, inclusive and tolerant societies?โ€

Speaking at the virtual event, CEO said that he sees potential in 5G broadcasting as the audience is increasingly moving away from traditional broadcasting to internet broadcasting. He said that one should be able to use the broadcast frequencies to directly reach citizens on their choice of device.

CEO Vempati discussed a number of topics like combating fake news and misinformation, building trust during the pandemic, technology, and more.

RAI is an Italian public service broadcaster. The event was organized in cooperation with the ABU on June 14 and 15, 2021.

Technology โ€“ enabler and rescuer

During the address, CEO Vempati spoke on the role of technology during the pandemic, which he said has been a huge enabler and a big rescuer, especially the digital tools and information technology system.

The right IT systems in place and the ability to quickly get the staff enabled on crucial digital tools came together in keeping the operations going and the basic technology played the role of a huge enabler for Prasar Bharati during the pandemic.

CEO Vempati said that going forward, advanced technology like artificial intelligence has a big role to play, especially in India, which has a diversified population. He also said that he sees potential in 5G broadcasting as the audience is increasingly moving away from traditional broadcasting to internet broadcasting. He said that one should be able to use the broadcast frequencies to directly reach citizensโ€™ on their choice of device.

He further added that with the increasing growth of digital platforms, good content is equally important.

Challenges to the public broadcaster during the pandemic

Speaking of the challenges the public broadcaster faced during the pandemic, the Prasar Bharati CEO said that the biggest challenge for them was tackling the flood of fake news and misinformation doing rounds on social media platforms during the pandemic.

โ€œOur whole understanding of the science of the pandemic was itself shifting every few weeks, every few months. Within that environment, you had a flood of misinformation, especially on social media platforms, WhatsApp groups, you know, wrong information going viral,โ€ he said.

Elaborating it further, he said, โ€œSo the biggest challenge for the public broadcaster was countering these, putting out the right information at the right time in all the possible languages, in all the different regions so that the citizens were accurately informed.โ€

The other challenge for the public broadcaster was meeting the high expectations of the citizens. โ€œIn India, public service media continues to be considered the most credible and authentic source of information. So often, when we get it wrong, it goes viral,โ€ he said.

โ€œWe have to be 100% sure that all the information that we put out is very accurate, because in the minds of the citizens, this is one place where they can get authentic and credible information, and they continue to rely on it,โ€ CEO Vempati added.

Increase in viewership during the pandemic

During the pandemic, when the country was under a lockdown, the public broadcaster was working every day and kept its services on. During this time, the public broadcaster also witnessed an extremely high viewership and Doordarshan broke every record out there in terms of television viewership for a series.

โ€œTelevision viewership hit an all-time high in India, we had the Epics, Ramayana and Mahabharat aired, (and) families got together during the lockdown. They were all glued to the television sets, watching Doordarshan,โ€ he was quoted as saying.

International cooperation during the pandemic

Prasar Bharati CEO Shashi Shekhar Vempati said that international platforms like ABU have been playing a critical role in bringing all together despite not having physical events and meetings, through the online and content sharing platforms.

โ€œWe have been able to share a lot of what was happening in India through the (content sharing) platform and that created a lot of awareness. Similarly, through the online sessions, there was a lot of exchange of best practices, lessons learned, so many new things we learned on how public broadcasters across the Asia-Pacific were coping with the pandemic,โ€ he said.

The pandemic was no longer a barrier as it was easy to go beyond the geography of Asia-Pacific and build relationships. โ€œWe were able to reach out to public broadcasters in Argentina, in Brazil, do online meetings, and put in place a content exchange program. The day that we had the interaction with our Argentinian counterparts, was the day that Diego Maradona passed away. So, we were able to leverage that relationship very quickly to get live feeds and live content from Argentina on the breaking coverage around that development,โ€ CEO Vempati shared.

Similarly, when Brazil launched its first satellite from India using the Indian space infrastructure, Prasar Bharati covered the live event and gave it to its Brazilian counterpart. โ€œAll of these happened online through Zoom meetings, working out the details and setting it up,โ€ he added on how technology, enabled international cooperation during this period.

Innovation is the key

During the pandemic, the public broadcaster faced disruptions with production. However, they engaged in a lot of innovative efforts. โ€œWe trapped into our archives and brought a lot of formats of content from our archives,โ€ he said.

During the pandemic, Prasar Bharati got writers and authors to read their books on radios remotely, and also put 10,000 different radio dramas online, on the digital platform for the first time which generated a new audience. โ€œWe got Ruskin Bond, a celebrated Indian author to read stories from his books for children,โ€ CEO Vempati said.

โ€œSo, new formats of content without a whole lot of in-studio presence, where you could remotely do it that made a difference to bring content during the pandemic. And this process goes on. FAITH

There are many times in life when we need someone to talk to us and listen to what we have in mind and that what we are going through was going to be okay and it IS okay not to be okay, like Demi Lovato sang in her song.

Faith. Faith is a funny thing. When we are happy and successful we seldom think of faith. We think it is only our hard work and a little bit of luck that led us to the success. But we are not doing well, we are told to have faith. We fail to remember that no matter the stage in our life, whether we are successful or not, there is some sort of faith, that belief we can do it, and that all the difficulty would be over, that would have led us through the difficulties, but we fail to acknowledge it.

What is, exactly, faith? When you google it, you may end up with the definition of โ€œstrong beliefโ€, or โ€œstrong religious belief. But if you really think about it, it is just really the trust we have on our higher power, whatever it may be. What is the difference between the trust and the faith. In my opinion, we use the word โ€˜trustโ€™ most of the time when we entrust someone mortal, someone we know who is human with some sort of job or an action. We use โ€˜faithโ€™ when we refer to God. Though both these terms can be misplaced, the meaning I gave is used usually and kind of makes sense in a way. You are free to feel otherwise.

Whether we believe in God or not, there is some sort of higher power that navigates us through life. Some people worship it in the name of God, some people feel just lucky and unlucky and some people think of it as Karma. But in general, it is rare to meet someone who feels that their life is in their control 100%. Do we support them or do we shun them is the real question? That depends on how that particular person would take the news.

There are difficult times in our lives when we yearn for all of it to be over. But we forget that all that sufferings improves us and makes us prepare for harder battles in the future. In that way, we need to have faith that whatever we are going through WILL be over, and that we would see our best days. In our happy days, we should feel grateful for what we have and it might sound crazy, but we should be feeling grateful about what we have left, even if we are not in a good position.

Donโ€™t think I am trying to preach about God. It is about us. It is about our actions. It is about our thoughts that shape us for who we are. If we are forced to take a decision, to follow someone blindly someone and it goes wrong, instead of blaming the person, think of it as your choice though you knew the consequences and that you would do better. Taking responsibility for what you do and did is the first step in having faith in yourself that you would do good. Remember no one can force you to do things you donโ€™t want to, so get out there and have faith in yourself.

According to Section 375 of the Indian Penal Code, Rape means illegal intercourse done by a man with a woman without her valid consent. Rape outrages a woman’s modesty. After a rape incident, a woman lives a pathetic life saturated with fear, depression, guilt complex, suicidal action, and social stigma. In recent times, Rape incidents have increased manifold. According to statistics, two women are raped in the country every hour. In addition, according to the statistics, every 10 hours, a girl age 1-10 is being raped in India. It appears that rapists are not scared of laws. The recent incident which shook the nation was the gang rape of a 23-year-old medical student in a moving bus on the streets of Delhi. The cruelty which was shown towards the girl by the rapists filled every Indian with wrath. Thousands of people came to the streets to demand justice for the young lady.
The protests compelled our leaders to sit up and think, and now amendments to the laws concerned with sexual assault on women are underway. Every day the newspaper reports of rape incidents. In the majority of rape cases, the victim knows the rapist. Some events are a rude shock to humanity. One of them was when a man raped her 5-year-old neighbor. Reports show that the rapist brutally destroyed her internal organs beyond cure. Some cases have come to light wherein teachers have raped their students. The question which arises when we talk of rapes is what causes rape. Why are rape cases increasing at an alarming rate? The first and foremost cause of increasing rape cases is the lack of public safety. Women are not safe outside their homes, and why only outside they are not safe even inside their homes.
Several cases have come into notice wherein the guilty has committed the crime in the very house of the victim. Rapes in moving vehicles raise a question on the effectiveness of the traffic system of our country. Another prominent reason is the sluggish court system of India and few convictions. India’s court system is painfully slow, and for rapes that do get reported, the conviction rate is not more than 26%. As the accused do not get any trial, others think that they can go around freely and rape whosoever they like. Stigmatizing the victim and encouraging the victim to compromise gives a further impetus to this horrendous crime. In many rural areas, the victim is forced to drop charges against the guilty and is encouraged to marry their rapist by telling them that nobody will marry them now and it will bring shame to her family. In recent times, prominent leaders and experts have blamed women’s clothing for increasing rape cases. No clothing is an invitation to rape.

How to Stop Worrying

Here are some tips on how to stop worrying:

โžข Take a problem-solving approach (as opposed to a worrying approach).ย Worrying and problem solving are two different things. Problem solving entails assessing a situation as objectively as possible and then coming up with tangible solutions for dealing with it.

Worrying, on the other hand, rarely leads to a solution. Instead, it generally involves obsessing with the problem and doing nothing, which leads to greater anxiety and stress.

In other words, no matter how much time you spend dwelling on the worst that can happen, you are no further ahead in being able to deal with it should it actually happen.

โžข Differentiate between solvable and unsolvable problems (worries).ย If you begin to worry about a problem ask yourself these questions:

Is this a present and real problem or a potential one?
If it is a potential one, how likely is it to happen?
If it is a likely one, what can I do to prepare for it?
Is it within my control?

Predictable and solvable problems and worries are those upon which you can take preemptive or immediate action.

For example; if you are worried about your bills you can make sure you’ve put enough money aside for any emergencies. If you have not, then you can contact the bank and make flexible payment arrangements accordingly.

If you are worried about your health, make sure you are eating properly, resting enough and exercising regularly. If you have a worrisome ailment, get it attended to as soon as possible. If need be, do some brainstorming to come up with possible solutions or preventative measures for solvable and probable problems.

Unsolvable problems, however, are those you have no control over. If you worry over a future circumstance that may, or may not, take place then there is nothing you can do about it in the present.

It would be unproductive to spend time ruminating over whether an earthquake, flood, war, or other catastrophe is going to take place. While it may happen, worrying about it will not help in the everyday living of your life. Focus on the things you do have control over and let go of those you do not.

โžข Plan ahead. This relates to the above point. Take preventative measures to avoid unpleasant circumstances and situations. You wonโ€™t worry about debts if you take care of your finances on a daily basis.

If you take care of yourself physically, mentally and emotionally, poor health will not be an ongoing worry for you.;

If you worry about getting good grades and passing your exams, make sure you prepare adequately by studying enough and completing all assignments. Don’t let something become a worry. Prepare yourself in every way possible.

โžข Understand that there are many things we have no control over.ย While it is important to be prepared, know and understand that there are circumstances totally beyond our control. Acceptance of this fact can prevent much worry and heartache.

Chronic worriers tend to have difficulty with unpredictability and the unknown. They believe if they worry about everything that can go wrong it will make life more predictable. On the contrary, their inability to tolerate doubt and uncertainty significantly increases their propensity for anxiety and worry.

They fail to realize that worrying about everything does not make life more predictable, it merely prevents them from enjoying it in the present. To really learn to stop worrying, begin by letting go of your need for certainty and immediate answers.

โžขย Challenge worrisome thinking cognitively.ย As you probably realize at this point, worrisome thinking is unproductive and unnecessary. To challenge such thinking ask yourself the following questions:

What is the evidence that supports this thought as being accurate?
What is the probability of it happening?
If it does happen, what can I do about it?
Is this thought helpful?
Does worrying about it help or hurt me?
Is there a more positive and productive way of looking at this situation?

Be aware of and avoid distorted thinking that can generate worry. For example:

Catastrophic thinking:ย Expecting the worst to happen; such as, if the person you are meeting for lunch is late and you begin to worry that they had a terrible car accident and may be seriously injured, or dead.

Over-generalization:ย Generalizing from a single negative experience expecting it will always hold true; such as, breaking up with someone and thinking you will never have a relationship again.

Jumping to conclusions:ย Interpreting situations negatively without any evidence; such as, someone looking at you questioningly and believing that they hate you, or are saying bad things about you.

All-or-nothing thinking:ย Looking at things as being either black or white with no middle ground; for example, thinking that if you don’t do something perfectly, you are a total failure.

Labeling:ย Avoid the notion of labeling yourself as a total failure, or loser, based on previous mistakes or perceived flaws.

โžขย Practice Mindfulness or similar relaxation techniques. Since worrying generally entails the future events, practicing mindfulness or meditation can alleviate it by focusing your attention on the present. In contrast to changing or challenging your worrisome thoughts, mindfulness entails observing and then releasing them. This also helps pinpoint the thinking and feelings that cause you to worry and send you into a tailspin.

So, rather than ignoring, fighting, or trying to control your worrisome thoughts and feelings, simply observe them without reaction or judgment. Consequently, when you don’t try to control them, your thoughts will slowly drift away and soon dissipate.

It’s only when you focus on your worries that they take on a life of their own and you lose perspective. Of course, it takes practice and continued application to become adept at practicing mindfulness, however, it’s well worth the effort to overcome the habit of worrying.

The Power of Hard Work

With a proven medication in hand, it was now time for human trials. Unfortunately, there were no centers in China performing trials for new drugs at the time. And due to the secrecy of the project, going to a facility outside of the country was out of the question.

They had reached a dead end.

Thatโ€™s when Tu volunteered to be the first human subject to try the medication. In one of the boldest moves in the history of medical science, she and two other members of Project 523 infected themselves with malaria and received the first doses of their new drug.

It worked.

Today, the artemisinin treatment has been administered over 1 billion times to malaria patients. It is believed to have saved millions of lives. World With One Currency

There is approximately $80 trillion in circulation worldwide, but only $5 trillion is paper-based.1 The rest is tied up in assets such as savings accounts, long-term deposits and stocks. These are usually represented digitally, meaning all of this wealth is stored as 1s and 0s. 

Why have different currencies if money is primarily electronic? Wouldnโ€™t it be simpler to adopt a universal currency that could be used for all people for all transactions around the globe? 

Economist John Maynard Keynes argued for such a system in the early 20th century โ€” long before digital money existed.2 In the years since thereโ€™s been growing support for a common currency. Is this a good idea? Letโ€™s take a look.

The benefits of adopting a universal global currency

Standardization removes confusion and friction, making it easier to collaborate. This is especially true when relevant actors hail from different backgrounds, nationalities, or cultures. 

NASAโ€™s Mars orbiter is a perfect example of what happens when group efforts donโ€™t follow standardized rules. One engineering team used imperial measurements, while another team used metric. As a result, the $125 million orbiters eventually vanished โ€” never completing its original mission.3 

You donโ€™t need to be part of the space program to appreciate the benefits of standardization. All you have to do is travel abroad without an adapter. Or try to convert one currency to another. Thereโ€™s unnecessary friction involved. 

Standardizing the worldโ€™s money would remove that friction. Better still, conversion fees would disappear entirely, allowing you to keep more of your money. And businesses would benefit from more accurate forecasting if currency fluctuations were removed from the equation. 

The benefits of a common currency donโ€™t stop there. 

  • Trade would become easier, precisely what happened when EU member countries adopted the euro as their official currency.4
  • Pricing manipulation would become harder, and countries wouldnโ€™t be able to make their exports artificially cheaper. 
  • Developing nations wouldnโ€™t be as susceptible to hyperinflation. With stable prices, they could invest more heavily in long-term economic development.

The dangers of adopting a universal currency

With a universal currency in place, individual countries would still control fiscal policy (i.e., how they choose to tax and spend money). But they would no longer be able to control the value or supply of that money through monetary policy (i.e., minting new bills or adjusting interest rates).  This poses a serious problem.

During the Great Depression, for example, the United States government was able to spur economic development by increasing the supply of money through monetary easing, also known as quantitative easing. This approach โ€” originally suggested by common currency supporter Keynes โ€” worked, for the most part. The government used monetary easing again during the 2008 economic crisis.5

With a universal currency, the supply and value of money would no longer be controlled at the national level. The entire world would have to agree on how many bills should be in circulation, and what interest rates to adopt. 

We can already see the limitations of this approach in the EU, where a country such as Greece is unable to dig itself out of crippling debt. Because this tiny nation doesnโ€™t control its money supply, it canโ€™t print more bills or adjust interest rates.6

A universal currency would also make the global monetary system even more centralized. There would have to be some oversight committee making worldwide decisions that affect everyone. It wouldnโ€™t matter if such a committee was appointed or elected โ€” that much centralized power would potentially open the door to unfettered corruption, graft and abuse. 

Because of these risks, it is very unlikely that the world will adopt a universal currency in the near future. At least not willingly.ย (copywriting)

BUT FEELING COMFORTABLE IS NOT ALWAYS EQUAL TO BEING HAPPY. HAPPYNESS IS ATTAINED BY SURPRISING OURSELVES WITH ACTS. ITS ABOUT DOING THINGS THAT REALLY MEAN TO YOU. HAPPINESS IS NOT ATTAINED BY REPEATING THE ROUTINES SO THAT YOU CAN FEEL COMFORTABLE. ITS NOT ABOUT KEEPING PEOPLE AROUND YOU HAPPY. A SHY BOY WHO SPENTS MOST OF THE TIME WITH HIS BOOKS MAY LIKE TO TALK TO HIS CLASSMATES. BUT HE IS ACCOUMSTED TO THE COMFORTABILITY IN STAYING AWAY FROM THE GROUP. TALKING REALLY MEANS A TEDIOUS TASK FOR HIM. BUT HE IS NOT AWARE OF THE HAPPINESS HE CAN ATTAIN BY TALKING TO THE PEOPLE. THE CHANGE MUST COME FROM HIS SIDE.

A CHANGE IN ROUTINE, A CHANGE IN CAREER , OR A CHANGE IN PERSPECTIVE MUST BE BOUGHT WHEN EVER WE FEEL SO. STICKING ON TO THE THINGS FROM PAST EVEN IF WE KNOW IT’S NOT RIGHT IS A MISTAKE. With the time medicines and technology has changed but one thing that hasnโ€™t changed is Medical Negligence. Even now, when we promise best medications and facility to patients, there are a number of evident cases which bring to our notice the medical malpractice that prevails in the recent times. Every practitioner possessing some skill owes a duty to the one he provides service to. Often, due to the carelessness of the practitioner this duty is breached on his part and as a consequence thereof the consumer suffers an injury/damage/loss.

A shocking fact is that even with advance technologies, cases of negligence havenโ€™t decreased to a noticeable extent. The most vulnerable person in the relation is the patient who expects to get treated but instead suffers a greater loss. In the crucial time of covid-19 pandemic, it is essential to note that the practice can be proved harmful o he citizens of our country. The virus is contagious and can spread from one to another quickly if not brought under control. But the number of increasing cases tells us a different story; it gives us the evidence of poor management and medical facilities. INTRODUCTION

When one person owes duty to the other and commits a breach of the same which results damage to the other, the person is said to commit negligence. Medical Negligence refers to negligence committed by a professional in the field of medicine. A Medical Practitioner at general needs to maintain a standard of care and in case they fail to do the same, they are liable for the damage made. The concept of medical negligence has developed to punish the wrongdoer and bring justice to the person who has suffered loss due to negligent behavior  of the latter. Negligence is punishable under many laws including Tort, Contract Act, Consumer protection Act and the IPC.

By the years, numerous patients have died, had permanent injuries, miscarriage, disablement and more due to the medical negligence of a professional. A patient is a consumer and expects necessary care to be practiced by the professional. However not every harm caused to patient during treatment is punishable or result of a negligent behavior. A professional is liable only to the extent to which the skills of a person in that field are considered reasonable. A doctor is expected to provide services which heal the patient and makes him/her physically fit. He is required to have the necessary skills and knowledge for the purpose and exercise reasonable degree of care. The standard of skills and care depends upon the qualification of the person. A doctor is expected to have more skills than an average nurse may have. Medical practice falls under the ambit of services, the Supreme Court in the case Indian Medical Association v. V.P. Santha explained[1]:

โ€œServices rendered to a patient by a medical practitioner (except where the doctor renders services free of charge to every patient or under a contract of personal service), by way of consultation, diagnosis and treatment, both medicinal and surgical, would fall within ambit of service as defined in Section 2(1)(o) of the Actโ€.

Medical Negligence is a serious issue and has been prevalent irrespective of the time. A person with no knowledge and skills that are required to treat a particular injury or disease is expected to commit negligence. The harm caused can vary from a temporary disability to death of the person. Generally, doctors indulge in activities like wrong treatment, overdose of medicines, carelessness about the health and capacity. If a patient suffering from Hepatitis and Jaundice gets a surgery without getting initial checkup for diseases and gets into even more serious condition that could even result into death if gets more serious, the doctor is liable for the negligence.[2] In such cases the doctors are liable for medical negligence in the treatment of patients and shall compensate or even be punished for the same.

MEDICAL NEGLIGENCE

Actionable negligence consists in the neglect of the use of ordinary care or skill towards a person to whom the defendant owes the duty of observing ordinary care and skill, by which neglect the plaintiff has suffered injury to his person or property.โ€

In usual meaning, negligence means carelessness towards something but in legal language it is the breach duty to exercise a certain standard of care that has resulted in some sort of injury. In the case of negligence the injury is generally foreseeable, hence a man, in order to prevent any harm or injury is expected to be preventive in his actions. There are cases when a man is careful but not accordingly to the situation which may also result in injury. If a person boards a train which has just started moving but forgets to close the door of the boogie, it creates danger for the people standing on the platform. And if a porter standing on the platform gets injured, the latter is liable for his carelessness as it is a duty of the boarding people to close the door as to prevent any injury to others.[8]

Medical Negligence

Professionals in the law of negligence are lawyers, doctors and architects. Professing a special skill requires adequate practice and knowledge of the task undertaken. This is the reason a medical practitioner is said to โ€˜practice medicineโ€™, even if the field requires proficiency a lawyer or doctor doesnโ€™t assure his clients of 100% success. In the case Indian Medical Association v. V.P. Santha[10], the judges explained the difference between โ€œoccupational liabilityโ€ and โ€œprofessional liabilityโ€. They state that a profession consists of success and failures and those we cannot expect the doctor or medical practitioner to always have success in every case. The liability can only be decided on analyzing the case as the standard of care differs from case to case. A case of patient suffering from flu requires less care than a person suffering from cancer. Also the possibility of healing also depends on the case and its severity. In M/s Spring Meadows Hospital v. Harjot Ahluwalia[11], the Court observed, that the judgment depends on case to case. If the error made by the person in charge would not have been made by an ordinary person competent and skilled to the same extent as the defendant acting with reasonable care, he must be held negligent. While if the error made by him could have been made by an ordinary person in the same situation he must not be held negligent. A homeopathic doctor giving allopathic medicine which causes the patientโ€™s death has been negligent and is liable to compensate as he was entitled to practice homeopathy only.[12]

Also, the term accident should not be confused with the consequence of negligence. Accident has a wider meaning. An accident means an unintended and unforeseen injurious occurrence; something that occurs in the usual course of events or that could not be reasonably anticipated.[13]

Res ipso loquitur[14] in Medical Negligence

The principle of res ipso loquitur is also applicable in the field of medical negligence. If the accident occurred would not have occurred if the management would have taken essential care and preventive measures, it proves to be an evidence for the liability. In such cases the management or the servants have been negligent towards their duties which resulted in the injury caused to the patient. In the case of Ashish Kumar Mazumdar v. Aishi Ram Batra Charitable Hospital Trust,[15] the patient has fallen out of the window of a hospital room, which clearly showed the negligence of the hospital staff. A three-judge bench of the Supreme Court applied the principle of res ipsa loquitur held the hospital liable for the absence of duty of care.

ESSENTIALS OF NEGLIGENCE

Negligence is the breach of a duty that a person owes to the other, caused by an omission which an ordinary man guided by the considerations of human conduct would not do; and the breach has resulted into an injury or damage to the person. Negligence has three essential components: โ€˜dutyโ€™, โ€˜breachโ€™, โ€˜damageโ€™.

The duty of care owed to the plaintiff;

The breach of duty on the part of defendant;

The damage caused to the plaintiff as a result of the breach.

Duty of the Doctor to attend a patient

If a doctor does not care to attend a patient in need to be admitted or attended the doctor will be held liable to compensate for any kind of loss that the patient suffers. There are many cases in which due to the non availability of the doctor at the time a patient has to suffer great injuries and even death. It was held inSishir Rajan Saha v. The state of Tripura[16]  that if a doctor is not available to attend a patient he will be liable for the damage caused. In the recent case, the petitionerโ€™s son met an accident while coming to Udaipur from Agartala on scooter. He was admitted to the G.B. Hospital, Agartala in the emergency ward. The senior doctor, Dr. P. Roy who was a specialist in the field wasnโ€™t available in the hospital at the time. He was continuously contacted and called to the hospital but chose to ignore as he was busy attending his patients in private. As a result the patient gave in to his injuries and died. The Court held the doctor liable to compensate Rs. 1, 25,000 to the father of the deceased. The Court also directed the Government hospitals to upgrade their services.

Duty of care

When a doctor attends his patient, he owes certain duties towards the patient:

  1. A duty in deciding whether to take the case,
  2. A duty in deciding the kind of treatment to give,
  3. A duty of care in the administration of the treatment.

In Dr. Lakshman Bal Krishna Joshi v. Trimbak Bapu Godbole[17], the respondentโ€™s son who was 20 years old met an accident on a beach and as a result femur of his left leg was fractured. He was taken to the appellantโ€™s hospital and during the treatment of reducing the fracture; the appellant gave him a single dose of morphia injection instead of giving an anesthetic. He used excessive force in handling the fracture and pulled the injured leg with three attendants. Then he put his leg into plaster of paris splints. The treatment gave a shock to the patient and as a consequence thereof he died. The doctor was held guilty of negligence by the Supreme Court.

In the recent case, the court held, โ€œThe petitioner must bring to his task a reasonable degree of skill and knowledge and must exercise a reasonable degree of care. Neither the very highest nor the very low degree of care and competence judged in the light of the particular circumstance of each case is what the law requires. The doctor, no doubt, has discretion in choosing treatment which he proposes to give to the patient and such discretion is relatively ampler in cases of emergency.โ€

In the case of Jagdish Ram v. State of H.P.[18], it was held that โ€˜ Before performing any surgery the chart revealing information about the amount of anesthesia ad allergies of the patient should be mentioned so that an anesthetist can provide ample amount of medicines to the patientโ€™. The doctor in this case gave an overdose of anesthesia to the patient and as a result thereof the patient dies. The doctor was held liable for the negligence on his part.

Thus, a treatment found to be not in accordance with medical protocol would be a case of medical negligence.[19] The doctor cannot be made liable for negligence in case when things have gone wrong. But if a doctor fails to provide medication necessary to the treatment and health of the patient, no one but the doctor is to be held liable for the act.

NEGLIGENCE DURING THE COVID-19 PHASE

At present, India is not adequately testing to identify new cases, which might be hiding the true number of cases. An incident of severe medical negligence was noted when the Patna All India Institute of Medical Sciences (AIIMS-P) handed over the body of a COVID-19 positive patient to his family members.

The government requires making strict rules to prevent the same, so that the justice prevails. People of India should be provided with adequate medical facilities, hygiene and sanitation. Laws should be strict for not only medicine but for all such professions to maintain a certain standard of care and prevent breach of duty.

The Government has announced that class 12 CBSE exams have been cancelled for the year 2021. The steps which follow is to create a “well-defined objective criterion” in a time-bound manner. It is safe to assume that many states will follow suit, and cancel their respective state exams for class XII based on the situation.ย  The media has stated that this is an appropriate and bold decision. But there are always two sides of the coin.

Cancellation of the exams can have several repercussions and severely impact the students, the educational authorities and the nation as a whole. Issues like college admissions and student results need to be discussed and decisions taken need to run parallel with not only the present, but also the future, since we do not know when the situation may get better.

Firstly, what could be this well defined objective criterion that is proposed by the authorities? Marks of the class X board examinations ? Evaluation of students by teachers? None of the above can test the actual knowledge the student possesses.

There are already notices issued by the Delhi High Court to the CBSE, Centre to re-approach their final decision to use marks attained in internal assessment of respective schools for class X board examination marks. Fact is that evaluations will always be subjective and educational authorities will try to reward their students with more marks, hence leading marks inflation across the state.

Instead, new educational norms can be created in the current situation which can be implemented even after Covid as a more effective way to help students. One example can be that students should be continuously monitored throughout the year. Technology provides, “Learning Management Systems” for such evaluations. Hence, the student can learn new things instead of studying for 8 hours a day during the last month before exams. If positive results are attained, final year examinations can be scrapped off completely, since it’s a burden to the students.

Truth is, we had ample time to look at the mistakes of the educational systems and the loopholes of effective management of examinations during the pandemic. JEE, NEET, CET and other such national and state level exams can be used as examples, to conduct offline exams in an appropriate fashion.

Cancellation of exams can have a serious impact on students mentally. Imagine you start preparing for your 10th board exams from 9th standard or the start of 10th standard. Your ultimate goal is to secure a good score in the final exams and get a seat in your dream college. Now, the exams get cancelled. Students will be judged on the internal exams conducted by the college or the school.

It’s very wrong to assume that internal exams in college test the skills and patience of the student the same way final exams do. A student may not score well in internals, but may be very prepared for boards. This does not give us a proper system to acknowledge the knowledge and skills of each student.

The fact that all this was not even explored and we instead went for the softer option of complete cancellation of exams is unfortunate. Official justification for the decision is that it is meant to safeguard student’s health. The government must seriously explore all the possible options so that we don’t find ourselves in the same situation in the coming years.

Lightning claimed many lives in India. Recently in West Bengal lightning death toll rose to 27. With an increasing number of tropical cyclones and the coming of monsoon the threat due to lightning has also increased. According to a report published by the climate resilient observing systems promotion council (CROPC), a non-profit organization that works closely with the India Metrological Department (IMD), there were 1,771 deaths due to lightning between April 1, 2019 and March 31, 2020. However, there was a reduction of 37% compared to the previous year. Uttar Pradesh saw the maximum death toll, followed by Madhya Pradesh, Bihar, Odisha and Jharkhand. These are also the areas that fall under the influence of Norwesters (Kalbaisakhi).

Why lightning kills?
Lightning is defined as a natural electric discharge of high voltage between a cloud and the ground or within a cloud. It occurs within a few milliseconds. Hence it is an electric discharge of very short duration. Bright flash and sound due to shock waves are observed with lightning. Intra and inter cloud (IC) lightning do not cause any problem. Cloud to ground (CG) lightning is responsible for death and destruction.
Electrification of clouds occurs then warm air mixes with cool air. A fast upward movement of air during the thunderstorm (updraft) carries humid air that turns into super cooled water and ice as it moves upwards through the freezing clouds (Altitude of 10 km where the temperature is -40ยฐC). Larger crystals (Graupel) are heavy and are present in the clouds. Moving water droplets (positively charged) and ice collide (positively charged) with each other and the Graupel (negatively charged) producing a potential difference that is, the top of the clouds are positively charged and lower parts are negatively charged. The Earth/ground is neutral (no charge) and a good conductor of electricity. However, in comparison to the middle layer of the cloud, it becomes positively charged. Hence the current gets directed towards the earth as well.
Most of the death are a result of people taking shelter below tree during rain. A side flash occurs when lightning strikes a nearby tall object like a tree and then jumps from the tree to a human. This happens within a radius of 2 feet from the object.
Though rarely but when a person is directly struck by lightning it can heat and burn the skin and travel to the ground through the nervous system.
Ground current is the electricity traveling along the ground especially in the presence of conductive materials like water when lightning strikes an object. This can kill a large number of humans and animals. In rural India where farmers are working in their fields drenched with irrigated waters fall victim to it.

Mitigation
The best way to prevent death due to lightning is through early warning systems that can alarm the people to take shelter before thunder storm. An application named Damini was developed by IITM to disseminate lightening alert. Other applications like Mausam and Meghadoot also help in early warning dissemination. Apart from this lightening as a disaster and the doโ€™s and donโ€™ts are taught in schools under disaster management. These initiatives by the government to improve early warning systems and establishment of monitors in vulnerable areas are commendable. It has resulted in reduction of death tolls. However, there is a scope for further improvement.

This generation of anthropogenic mass has increased exponentially over the past 120 years. Artificial material has gone from just 3 percent of the worldโ€™s biomass in 1900 to on par with it today. And the number of new products being produced every week is equivalent to the average body weight of all 7.7 billion people.

This is becoming a matter of concern due to its deteriorating effects on living forms and nature. The innovations and discoveries are showing a tremendous surge in almost all the fields by human beings, which is also called development by most people, the earth is now facing several environmental changes which will actually take years to renew.

Plastic is known as the biggest threat to the environment, which now weighs twice the weight of all zoological forms on the earth. Similarly, infrastructure like roads and buildings outweigh shrubs and trees. Demolition of National Archives annexe in India.

Recently government announced that under the Centre Vista Redevelopment project it has proposed to demolish the National Archives annexe and replace it with newbuilding. The main building of National Archives will not be demolished.

National Archives annexe building is a house for several important documents relevant to historical research. The building has cartography section and 1,50,000 oriental records in Persian, Arabic, and Urdu.

More than 100 historians in India and across the world have written to head of National Archives seeking clarity on how documents are stored in archives annexe that is imminent to be demolished. Leading Scholars from India and foreign are circulating a petition demanding the government to have more transparency in the proposed demolition of the annexe and safe storage of its contents.

A number questions are unanswered and the process is being carried on in an opaque manner without the consent of the public, archivists, scholars etc,. The protestors against annexe demolition include scholars holding important position in some of the best institutions.

China warns G7 leaders

In a recently leaked communique, the G7 has reportedly called out China on several sensitive issues, including human rights violations in Xinjiang, the autonomy of Hongkong and the unilateral actions in the south china sea. This statement of G7 is in the context of the rising global power of China. China is seen as a threat to the USA’s global dominance. That’s why earlier Donald Trump and now Joeย  Biden consider china as the main strategic competitor. Biden has also made a case to take action against China’s economic abuses and human rights violations. Before the statement issued by G7, china had already warned western countries and the group against any move that concerns Chinese interest. For China, the criticism by G7 is a danger to its sovereignty and a manifestation of an “outdated imperial mindset” of the western countries. G7 also said that they are concerned about peace in the Taiwan strait and also want a transparent investigation of the covid origin by WHO.

What is G-7?

Group of Seven (G-7) is an informal political organisation that was set up in 1975 mainly to counter OPEC’s oil embargo. Which now coordinates on global issues. Its member countries are Japan, France, U.K, U.S, Germany, Canada and Italy. Except for Japan, all other members are also members of NATO making the G7 influential. The UN experts have estimated that more than 10 lakh Uyghur people have been sent to detention camps by China and it can be called ‘cultural genocide’. But China has outrightly denied all these acquisitions. China has projected these detention camps mere as a ‘vocational training centre’ and said these centres are to counter extremism. In a UNHRC resolution submitted by 22 nations on human rights violation of the Uyghur population, 33 nations have defended china demonstrating the rising power of China. While mainly the western countries are criticising china on several issues, other countries mainly from Africa and Asia have been defending china. Even Saudi Arabia also backed china which is a strategic Allie of the US. Because of this geographical, geopolitical divide china feels confident against G7.

Our eating habits of today have largely been effected by the modern way of life. Eating in the right way has a great effect on one’s feelings, energy, mood and overall health. In this article, let us look at what ayurveda has to say about eating.

Great ideas that have changed the world were born out of observation. People who were great observers of the external world have contributed significantly in all the fields. In a similar manner, Ayurveda is the knowledge given to us by sages who observed the internal world. The perspective of Ayurveda on eating is an interesting one and is based on the observations of the internal body.

According to ayurveda, more than 90% of the diseases arise from the stomach and it suggests certain practices for proper digestion. Ayurveda classifies food into three types based on its qualities – Goodness(fruits and vegetables), passion(foods that are bitter, sour, salty, dry and pungent)and ignorance(meat, processed food). These foods also impact the state of mind. It advises to prefer foods of the quality of goodness. According to ayurveda, the digestive fire called agni is responsible for the process of digestion. The digestive fire is strong when the sun is at its peak. For this reason, it advises to eat like a prince in the morning, like a king in the noon and like a pauper in the evening. It strictly advises to not eat post sunset so that body can focus on healing rather than digesting food. Ayurveda also advises to eat at fixed times so that it becomes a habit and digestion is optimal. It advises a gap of 4 hours between meals and advises against snacking.

Ayurveda also advises against certain food combinations. Milk with other oily foods, fruits and other food items, uncooked and cooked food, milk and vegetables and acidic fruits with alkaline fruits. It advises strictly against consuming fruits, curd, radish and banana post sunset.

As ayurveda believes in the connection between the mind and the gut, it prescribes mindful eating and eating in a pleasant atmosphere. It also advises against overeating as it burdens the digestive system and leads to the build up of toxins. Ayurveda advises to drink warm water. It is beneficial if warm water is consumed upon waking up and quantity of water depends on thirst. It advises not to drink water after meals as water extinguishes the digestive fire(water can be consumed after 1hr of having meals).

Other eating habits prescribed by ayurved include – avoiding eating while standing, avoiding eating while doing other works, to wait for 5 minutes after eating and get up immediately , standing and drinking water, eating slowly and chewing properly. It advises to stop eating after a burp(is seen as a signal from body) and this can be used as a measurement of how much to eat. It advises the inclusion of all 6 tastes for eliminating unwanted cravings and better digestion. Eating processed foods affect the digestion and should be avoided. Ayurveda believes fasting as a highly beneficial habit and can be done occasionally. During fasting the body is detoxified. Following these habits will ensure longevity and quality of life.

Ashwani Kashyap popularly known as ‘Johnny Dada’ and ‘Tiktok villian’ attempted three murders within four days. Investigators believe that he loved a girl since his childhood who was then working as an air hostess in Dubai. Rejection from the girl is believed to be the root cause behind the killings. This wasn’t really surprising because he regularly posted extreme messages over various social media platforms. One of those messages “jo mera nhi ho sakta mai usse kisi aur ka mauka nhi dunga” which is a dialogue from the movie ‘Kabir Singh’.

So can movies really motivate someone for criminal activities, and if so should such movies be banned?

‘Kabir Singh’ is the Hindi remake of a Telegu movie ‘Arjun Reddy’. The movie fell into a controversy due to the way the main character of the movie was being glorified. The main character of the movie played by Shahid Kapoor attempts sexual violence several times in the movie and all such activities were being justified because the character was a brilliant doctor. Critics believe that the problem wasn’t that sexual harassment scenes were shown but that such behavior was never condemned. The movie did well at box office earning about three hundred crores.

But ‘Kabir Singh’ wasn’t the only movie stuck in controversies. ‘Joker’ has also been a box office hit. On one hand it received standing ovation at major film festivals such as Venice Premiere while on the other hand people wanted it to be banned. The main character in this movie is an average looking person who’s publicly humiliated, misbehaved by his co-workers, loses his job and as a consequence his mental health. The only instant when the character receives support and attention is when he attempts a murder on live television and thereafter he’s treated like a hero in the movie. In the past years US faced a huge number of mass shootings and this was the reason people were afraid that the movie could motivate other such mentally unstable people who wish to gain attention through violence for mass shootings. Especially when in many scenes, the film-makers attempt to ask viewers to sympathize with the Joker. And this fear is not surprising, given America’s history of mass shooting.


Defending the movies

These are the most common arguments presented by the makers to defend their movies.

Makers of ‘Joker’ asked why there were no such controversies about movies like ‘John Wick 3’ which showed much more of murders and violent scenes. While Shahid Kapoor asked why there were no controversies about movies like ‘Baazigar’ where the character played by Shahrukh Khan murders the main female character of the movie, or the scene from the movie ‘Sanju’ where the main character Sanju puts a toilet seat round the neck of Ruby.

One reason could be because other movies like ‘Baazigar’ and ‘Sanju’ did not show as many anti-women scenes as there were in ‘Kabir Singh’. But the comparison of ‘John Wick 3’ did seem valid to some extent. The answer could be that more people can identify themselves with the main character of ‘Joker’ while it’s not the case with other movies like ‘John Wick 3’ or ‘Fast and Furious’. The stunts, weapons, looks etc. of characters of other action movies are not much relatable to the mass while the looks, problems, life and world of Joker is relatable for the ordinary people.

Research studies on whether movies and media has impact on human behavior have mixed conclusions. It isn’t clear which movies impact behavior in what ways but media does have some impact on daily life and thus behavior hence makers can’t say confidently that their work doesn’t influence behavior at all. Research studies broadly suggest that violence in movies doesn’t have much impact on real life while sexual violence in movies does have some influence. One possible reason of such conclusion might be that violence is attempted against the villian and for each story the villian keeps changing whereas in case of sexual violence, almost always women are the victim.


Solutions

Banning such controversial media is not a solution as this violates the freedom of expression.

Certification also helps but not to a great extent.

One such solution being discussed is if a message is shown in the beginning or at the end of such movies where the directors or actors convey clearly that such behavior is not being promoted and should not be justified may have a good impact.

It is hard to tell if people like Ashwani Kashyap would have dropped their plans of murder due to such a warning but there’s no harm to at least try such solutions.

OTT PLATFORMS: THE WAY TO GO?

Long queues for tickets, matinee shows, popcorns and sodas are staples when it comes to watching movies. When we look even back, there would be a common night for even watching TV. Many were not able to afford for a TV, and if a house had one, the whole neighborhood spent the Friday nights listening to cine songs.

Then came TVs in almost every house, still not a common thing, but everyone knew what it was and some of the famous shows. Fashion started and ended by watching movies and televisions. Bell bottom pants, butterfly clips, favorite dialogues were all the rage for the teenagers of the 80s and 90s. It was a ritual to go to movie theaters and even a bigger deal to get the โ€œFirst Day, First Showโ€ tickets.

Now, stuck at home, every house with a smart TV and a OTT (Over The Top) subscription. The famous ones being Disney Hotstar+, Amazon Prime, Netflix, Zee5 etc. Netflix and chill has become a common phrase. And also this pandemic has seen a rise in the home food delivery which makes it even more โ€œlethargicโ€ in a sense.

Almost all of the movies are released in one or the other OTT platforms and we need to have every subscription, because who knows which movie will release where. The very sense of going to the theatre to get entertainment out of the house has been thrown out of the window.

Box office, Housefull, First class tickets, 10 rupees tickets which was the most popular and the fact of sitting so close near the screen, the screaming for the title card were all the signs that the movie is a successful one. Now, we donโ€™t know whether itโ€™s a hit or flop, unless it is the movie of a superstar.

Another thing is that, those days there would be only 5 to 10 movies a year, and a repetition of the same actorโ€™s movie was rare. All the dialogues were memorized and played among friends as a sort of pastime. One of the benefits of OTT is obviously, the lack of crowd and there is safety and comfort of being in oneโ€™s own home. Other benefit is it opens a chance for every amateur actors and directors to have a chance to release their movies and short films, and not only in OTT, also in networks such as YouTube.

We are yet not sure about the situation in the environment. There are people who are crazy about the โ€œFDFSโ€ (First Day, First Show) and they miss the good old days. Even die hard fans of movie stars want to see their favorite actor/actressโ€™ in the big screen to celebrate.

The TV networks are working hard to capture the attention of the public through various reality shows but since there are restrictions for the shooting activities, they are not able to give it their all. For some time, IPL fans were entertained, but it had to be stopped due to obvious reasons. It will be a relaxation that BCCI is planning to conduct the rest of the matches in UAE and soon too. Home makers and children alike were entertained with the Bigg Boss in their native languages but that also had to have a stop for the safety of the artists.

Last week, WhatsApp Chief and Facebook CEO, in a conversation with WABetaInfo revealed how they were working on soon bringing multi-device support on WhatsApp enabling users to switch between four different devices on the fly. With this feature, they also plan on bridging WhatsApp to iPad — again something several iPad users have been asking for a while now. They also announced that they would be rolling out more open beta sign-ups for iOS users soon.
